Welcome to Weirdiesland. These Terms of Use govern your access to and use of weirdiesland.com and any related websites, mobile sites, or apps we operate, as well as your purchase of products from the Site.

BY ACCESSING OR USING THE SITE, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SITE.

Note to consumers in the EEA/UK: nothing in these Terms limits your mandatory consumer rights under applicable law.


1) Account Registration

Some features require an account. When you create an account, you agree to:

  • provide accurate, current, and complete information;

  • keep your password confidential and secure;

  • be responsible for all activity under your account; and

  • notify us promptly at support@weirdiesland.com

 

We may suspend or terminate your account at our discretion for breach of these Terms or suspected misuse.


2) Orders & Fulfillment

(a) Products & Services. To buy on the Site you may need to provide payment information (e.g., card details), billing/shipping address, and contact data. You represent you are authorized to use the chosen payment method.

(b) Made-to-Order. Most items are printed on demand via our partner once you place an order. Minor variations in color, placement, sizing, or materials can occur across batches, screens, and printers—this is normal for print-on-demand.

(c) Availability. We may limit quantities, refuse or cancel orders (e.g., suspected fraud or reselling), and update product information at any time.

(d) Order Acceptance. Your order is an offer to purchase. We accept only when we issue a shipping confirmation. If we cancel before acceptance and you were charged, we’ll refund the relevant amount.

(e) Pricing, Taxes & Duties. Prices may change without notice. Prices exclude applicable taxes, duties, customs, or import fees, which are your responsibility where applicable. At checkout we may estimate taxes; final amounts may vary by jurisdiction.

(f) Payment. You authorize us (or our payment processors—e.g., Shopify Payments, Stripe, PayPal) to charge your selected payment method for the order total, including shipping, taxes and duties where applicable.

(g) Shipping & Delivery. Delivery times are estimates and may vary due to carrier delays, customs, and production volumes. Risk of loss passes to you upon delivery to the carrier; title passes upon full payment.

3) Promotions

From time to time, we may run promotions, contests, or giveaways. Each may be subject to separate rules. If rules conflict with these Terms, the promotion rules control for that event.


4) Intellectual Property

The Site and its content, including designs, graphics, text, images, logos, trademarks, trade dress, audiovisuals, code, and compilations (collectively, “Materials”), are owned by or licensed to Weirdiesland and are protected by intellectual property laws worldwide.

Except as expressly permitted in these Terms, no license is granted. You may not copy, modify, create derivative works, distribute, sell, lease, reverse engineer, or exploit the Materials.


5) Limited License to Use the Site

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. You agree not to:

  • frame or mirror the Site;

  • use bots, scrapers, or similar tools (other than standard search engine/browsers);

  • interfere with Site operation or security; or

  • remove/alter proprietary notices.

We may revoke this license at any time.


6) Your Submissions & User Content

(a) User Content. If you post, upload, or submit content (e.g., reviews, comments, photos) (“User Content”), you represent you have all rights required to do so and that your User Content is lawful, accurate, and not misleading.

(b) License to Us. You grant Weirdiesland a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to host, use, reproduce, display, distribute, publish, adapt, and create derivative works from your User Content in any media to operate, promote, and improve the Site and our business. Where permitted by law, you waive moral rights.

(c) Rules. You will not submit content that is illegal, infringing, defamatory, hateful, harassing, obscene, or that contains malware, advertising, or personal data of others without consent.

(d) Moderation. We may monitor, remove, or refuse any User Content at our discretion but have no obligation to do so.


7) Copyright Complaints (DMCA/Notice Procedure)

We respect intellectual property rights. If you believe content on the Site infringes your copyright, send a written notice with:

  • your contact details;

  • identification of the copyrighted work;

  • the exact URL/location of the allegedly infringing material;

  • a statement of good-faith belief that the use is not authorized;

  • a statement under penalty of perjury that your notice is accurate and you are the owner or authorized agent; and

  • your physical or electronic signature.

8) Third-Party Services & Links

The Site may link to or integrate third-party sites, services, apps, or content (e.g., Shopify, Gelato, payment processors, analytics, social networks). We don’t control third-party services and aren’t responsible for their content or policies. Your use of third-party services is governed by their own terms and privacy policies.


9) Acceptable Use

You agree not to:

  • violate laws or rights of others;

  • attempt to gain unauthorized access to the Site, accounts, data, or systems;

  • interfere with or disrupt the Site or networks; or

  • use the Site for any fraudulent, harmful, or abusive activity.

We may investigate and cooperate with law enforcement regarding violations.


10) Disclaimer of Warranties

THE SITE, PRODUCTS, AND MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, AND QUIET ENJOYMENT.
We do not warrant the Site will be uninterrupted, error-free, secure, or that defects will be corrected.

Some jurisdictions do not allow certain disclaimers; in such cases, this section applies to the maximum extent permitted by law.


11) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WEIRDIESLAND AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND PARTNERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) AT ISSUE OR €100, WHICHEVER IS GREATER.

12) Indemnification

You agree to defend, indemnify, and hold harmless Weirdiesland and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
(i) your use of the Site; (ii) your User Content; (iii) your violation of these Terms; or (iv) your violation of rights of any third party.


13) Suspension, Modification & Termination

We may, at any time and without liability, modify, suspend, or discontinue the Site (in whole or part), change product offerings or prices, or terminate/suspend your access for any reason, including breach of these Terms. Upon termination, your right to use the Site ends immediately.


14) Territorial Use & Compliance

We operate from [France] and sell internationally. You are responsible for compliance with local laws where you access the Site. We may restrict access to certain regions or products at our discretion.


15) Governing Law & Dispute Resolution

(a) EEA/UK Consumers. These Terms are governed by the laws of France without regard to conflict-of-laws principles. You may bring disputes in the courts of your place of residence or in Paris, France, and mandatory consumer protections of your country of residence still apply.

(b) US Residents (Arbitration/Class Waiver). If you reside in the United States, you agree that any dispute arising out of or relating to these Terms, the Site, or products shall be resolved by final, binding individual arbitration administered by JAMS under its Consumer Arbitration Rules. No class actions or representative proceedings. Each party bears its own attorneys’ fees unless the arbitrator awards otherwise under applicable law. If this arbitration agreement is found unenforceable as to a particular claim for a specific reason, that claim may proceed in court; all remaining claims will proceed in arbitration. Venue for any court proceeding shall be the state or federal courts located in [County/State]. You and we waive jury trial to the extent permitted by law.

(c) Informal Resolution First. Before filing arbitration or court action, the parties will try in good faith to resolve disputes by emailing support@weirdiesland.com with subject “Legal Notice” and allowing 30 days to resolve.

Nothing in this Section limits any non-waivable statutory rights (e.g., EU/UK consumer rights).


16) Changes to These Terms

We may update these Terms periodically. Changes are effective when posted on the Site with a revised “Last Updated” date. Your continued use of the Site after changes means you accept the updated Terms.


17) Miscellaneous

  • Entire Agreement. These Terms (plus any policies referenced—e.g., Privacy Policy, Returns Policy) form the entire agreement between you and us regarding the Site and purchases.

  • Severability. If any provision is invalid or unenforceable, the remaining terms remain in effect.

  • No Waiver. Our failure to enforce any term is not a waiver.

  • Assignment. You may not assign these Terms without our consent. We may assign these Terms at any time.

  • Headings. Headings are for convenience only and have no legal effect.
